Building law department (lower building supervisory authority)

In the area of building law, this includes the review of decisions up to the examination of the violation of neighboring rights, the processing of objection and complaint proceedings, the disposition of non-favorable administrative acts, such as the refusal of building applications and applications for preliminary building permits, prohibitions of use for the protection of life, health and property as well as removal orders.

Security area

Structures are monitored as part of hazard prevention. Compliance with public law regulations must be ensured. Within this framework, measures must be taken to avert hazards that may arise due to non-compliance with building regulations.

Building load/division/separateness area

The register of building encumbrances is kept in this area and information from it is provided. By encumbering one or more properties, the permissibility of a building project is to be achieved that would not be approvable without the entry of a building encumbrance. In most cases, the registration of building encumbrances involves the assumption of clearance areas, the securing of development (footpath, driveway or pipeline rights), proof of parking spaces on another property or the elimination of violations of building regulations in the case of boundary overbuilding. Applications must be submitted to the lower building supervisory authority.
If a property is to be divided, a certificate will be issued in this area upon application. The division of a plot of land must not create any conditions that contravene building regulations.
Certificates are also issued in accordance with the law on residential property and permanent residential rights ("Abgeschlossenheitsbescheinigungen"). A certificate of seclusion is a certificate stating that a condominium or partial ownership within the meaning of the German Condominium Act (Wohnungseigentumsgesetz) is structurally sufficiently separated from other apartments and rooms. The certificate of seclusion is a prerequisite for the division of a building into condominiums or partial ownership for the creation of separate land register sheets. Applications for a certificate of separation must be submitted to the lower building supervisory authority.

Building archive area

The building archive of the city of Gera is affiliated with the lower building supervisory authority. Building files are stored here indefinitely, made usable and preserved. Building files can be inspected in the building archive in accordance with data protection regulations. Any citizen who can demonstrate a legitimate interest may be granted access to the files on request. Copies can also be made available on request. A request for inspection can be sent by post or by e-mail (by attaching the completed form) to the Building Projects and Urban Development Department and should be submitted before the files are inspected. Please make an appointment for inspection.
